1. Publisher/Organiser
The website accessible at www.bananalotto.co.uk and related URLs (the “Site”) is owned, published and operated by MEDIASTAY Limited C/O SPAIN BROTHERS & CO 29 Manor Road Folkestone, Kent CT20 2SE ENGLAND (“we,” “us” “our,” “Mediastay”). Company Registration No. 5958600.
The Site contains a game with prizes which is free of charge to play called Bananalotto (“Bananalotto”) and which is offered to players via the Site in the United Kingdom (“you,” “your,” “Player”) subject to the following terms, conditions and rules. Bananalotto is run and administrated by Mediastay.
2. Bananalotto is Free to Play - No Purchase Necessary
Bananalotto is entirely free of charge to Players to enter and no purchase is necessary by any Player to enter and play Bananalotto.
Mediastay reserves the right to modify or cancel any Bananalotto game if necessary on reasonable notice to Players who have already entered the Bananalotto game in question. In such circumstances, no indemnity or compensation will be given to the Players involved.
3. Availability of Bananalotto and Restrictions of the Internet
Subject to technical problems and the remaining provisions of this clause, Bananalotto will be made reasonably available via the Site 24 hours a day and 7 days a week and Bananalotto is open to all members of the public without restriction, subject to these terms, conditions and rules.
You acknowledge and accept that Mediastay has no control over the Internet, which is a global decentralised network of computer systems. Access to the Site and Bananalotto games, therefore, will not be error free or uninterrupted and may be disrupted and very variable.
The Site is maintained in partnership with Mediastay's hosting service providers. Every effort is made to ensure the continuity of the Site and Bananalotto, but some occasional technical downtime beyond our control and/or the control of our hosting service provider may occur.
You acknowledge and accept that such downtime may prevent the Site being viewed and may restrict access to your account or the ability to enter Bananalotto games from time to time. You acknowledge and accept that the disclaimers and limitation of liability relating to the errors and downtime set out in clause 16 will apply.
4. Promotional Materials and Advertising on the Site
The promotional and advertising material of third parties on the Site is not intended to be for end-users in the United States of America and in particular, any end-users located in the following states of the United States of America: Arizona, Delaware, Iowa, Louisiana, Arkansas, Tennessee, Vermont, Connecticut, Florida, Montana and Illinois.
We do not knowingly allow promotion or advertising on the Site which is intended for, targets or relates to any promotion to end-users in the United States of America or promotes gambling to end-users in the United States and in particular any end-users located in the following states of the United States of America: Arizona, Delaware, Iowa, Louisiana, Arkansas, Tennessee, Vermont, Connecticut, Florida, Montana and Illinois.
All third party promoters or advertisers that display promotional materials on the Site comply with the Site's Website Terms of Use. Any such third parties which display promotional materials on the Site have provided us with assurances that they will (i) comply with all gaming and advertising laws in the United Kingdom, (ii) comply with all laws in jurisdictions which they intend to target, and (iii) will not promote gaming to end users in the United States and in particular end-users located in the following states of the United States of America: Arizona, Delaware, Iowa, Louisiana, Arkansas, Tennessee, Vermont, Connecticut, Florida, Montana and Illinois.
5. Registration Procedure
In order to register with the Site and to be permitted to play Bananalotto, each Player must register on the Site and will be required to enter the following personal information: user ID (valid e-mail address); password; surname; first name; gender; date of birth; and postcode.
You will be entirely responsible for the accuracy and completeness of the personal information, which you provide to Mediastay on registration with the Site. Mediastay will not be liable for any loss, damage or claims caused by the inaccuracy or incompleteness of such information.
Mediastay reserves the right to ensure equal opportunities for all Players, by any means Mediastay reserves the right to refuse to register any Player and to cancel any Player's registration with the Site at any time for any reason without notice only in the event that the Player is under the age of 16 or is in breach of these terms.
Players must ensure that their registered details are kept accurate and up to date at all times in order to ensure eligibility to win prizes on Bananalotto. Mediastay will not be liable for any loss, damage or claims caused by the inaccuracy or incompleteness of such information.
6. Entry Requirements
Entry and participation in Bananalotto is subject to these terms, conditions and rules and you agree to comply with them and all applicable laws and regulations.
Bananalotto is only accessible via the Site and so access to the Internet will be required to enter Bananalotto. All entries by Players to Bananalotto games must be made via the Site and all entries to Bananalotto games sent or purported to be made via any other method will be null and void.
Entry to Bananalotto is open to any member of the public who are over the age of 16 years (i.e. individuals resident in the United Kingdom) subject to these terms, conditions and rules. By entering Bananalotto you, therefore, confirm that you are over 16 years of age and in the event that you are not, any entry to Bananalotto you purport to submit will be deemed null and void. For the avoidance of doubt, any Players who are under the age of 16 will be infringing these terms, conditions and rules and accordingly will not be permitted to claim any prizes whatsoever from Mediastay.
Bananalotto is not open for entry to employees of Mediastay or its associated companies or their families or agents or any third parties professionally involved with Mediastay or any promotions or advertising linked to Bananalotto.
It is a condition of entry, and accordingly you hereby agree, that you will be entirely responsible for any tax liabilities, if any, in respect of any prize you may win on Bananalotto. For the avoidance of doubt, Mediastay will not be responsible or liable for any tax, levies or duties, if any, applicable in any country which may apply to Bananalotto prizes.
By participating in any Bananalotto game, you agree that Mediastay will be entitled to publish on the Site and in all Mediastay communications your first name and initial of your surname, your image and your likeness (without restriction or reservation and without any payment, fee or advantage to you) in connection with any prize you may win.
7. Playing Bananalotto
To enter a Bananalotto game simply enter your user ID (valid e-mail) and password (chosen by you when registering) where indicated on the Site. Players must choose six (6) numbers in a lottery grid of forty-nine (49) numbers in order to enter the relevant Bananalotto game.
To confirm each entry to play a Bananalotto game, you must click on an advertising banner as indicated on the Site.
You agree not to misuse the Site or any Bananalotto game. You hereby also agree not to modify or attempt to modify the Site or any Bananalotto game by any means including but not limited to modifying the “Results” as determined by Mediastay and set out on the Site and/or any element that determines such “Results” and/or the winners of Bananalotto games as determined by Mediastay and set out on the Site which you acknowledge and agree is strictly prohibited. Mediastay will not be liable in any circumstances for claims or damages caused to any Player or third party as a result of a breach of this clause.
Each Player must be a separate legal person entitled to play Bananalotto under the Entry Requirements above. For the avoidance of doubt, you are not permitted and you agree not to play or attempt to play Bananalotto with several different user IDs (e-mails) or using an account registration opened in another person's name, which are prohibited under this terms, conditions and rules. In the event that you are in breach of this clause, Mediastay will be entitled to immediately cancel your registration and may refuse to re-register you.
Special Bananalotto games and draws may be announced by Mediastay regularly with specific terms, conditions and rules available and posted on the Site in the "Rules" section. If you wish to enter any such special Bananalotto games, you will be required to accept all such specific terms, conditions and rules relating thereto.
8. Time Limits for Entry into Bananalotto Games
Subject to these terms, conditions and rules, a new Bananalotto game will be held every day and will run for a period of that day (i.e. a 24 hour period from 00:00 (UK time: GMT) to 00:01 (UK time: GMT). Any entry to a Bananalotto game received after the end of this period (i.e. after 00.01 hours (UK time: GMT)) for the previous Bananalotto game will automatically be entered into the following day's Bananalotto game.
In the event of any uncertainty as to whether or not an entry to a Bananalotto game is received prior to the end of the relevant designated period for the Bananalotto game in question in accordance with the above clause, Mediastay's decision will be final.
Players are permitted to submit up to ten (10) entries to Bananalotto (i.e. ten grids of lotto numbers) in any 24-hour period between 00.01 hours (UK time: GMT) and 00:00 hours (UK time: GMT) the next day. All entries by Players over and above that limit made during the relevant time period will be deemed null and void.
9. The "Draw" and Notification
Winning numbers for each Bananalotto game will be selected and notified in accordance with the terms of this clause.
Six (6) numbers from the range of one (1) to forty-nine (49) will be randomly drawn every weekday after 00:00 hours (UK time: GMT) by a computer application developed by Mediastay in relation to the Bananalotto game of the previous day (“Draw”). These winning numbers will be displayed on the Site shortly thereafter.
In addition to the six (6) winning numbers being posted each day on the Site, they will also be notified by e-mail to all Players via e-mail addresses provided by Players on registration.
The winning Player or Players for each Bananalotto game will be decided by matching the numbers on each of their respective entries with the six (6) winning numbers drawn in accordance with the above provisions of this clause 9. Players with matching numbers will also receive a notification e-mail from Mediastay within 15 days of each relevant Draw requesting that they claim their prize in accordance with clause 10 below.
The results of Draws for Bananalotto games are final and binding and no correspondence will be entered into between Mediastay and any Player regarding the results of a Bananalotto Draw.
10. Winning Numbers and Prizes
6 winning numbers on grid 10 with bonus number: If a Player validly matched five (5) numbers correctly + the bonus number in its rightful place (6th) on the Player's 10th entry for the relevant game Bananalotto to all six numbers, including the bonus number in its place, drawn for the relevant Bananalotto game, they may claim £12,500 per semester for four years, making up an amount of £100,000 (one hundred and fifty pounds)
6 winning numbers on grid 10: If a Player validly matches all six (6) numbers correctly from the 10th entry of the day to Bananalotto (i.e. the tenth lotto grid entered by the Player for the same Bananalotto game as permitted in accordance with these terms, conditions and rules), if any, to all six numbers drawn for the relevant Bananalotto whatever their order, they may claim £10,000. In the case where more than one player selects the correct numbers drawn, the total amount will be shared equally between, details of how it is to be provided to confirmed winners is set out in the Schedule
6 winning numbers on grid 1-9: If a Player validly matches all six (6) numbers correctly from any entry of theirs to a Bananalotto game, other than the Player's 10th entry for the relevant Bananalotto game (see provisions below), to all six numbers drawn for the relevant Bananalotto game, whatever their order, they may claim £1,000. Details of how it is to be provided to confirm winners are set out in the Schedule.
5 winning numbers on grid 10: If a Player validly matches five (5) numbers correctly from their 10th entry of the day to Bananalotto (i.e. the tenth lotto grid entered by the Player for the same Bananalotto game as permitted in accordance with these terms, conditions and rules), if any, to five (5) numbers drawn for the relevant Bananalotto game, they may claim £20 Amazon voucher from Bananalotto. Details of how it is to be provided to confirm winners are set out in the Schedule.
5 winning numbers on grid 1-9: If a Player validly matches five (5) numbers correctly from any entry of theirs to a Bananalotto game, other than the Player's 10th entry for the relevant Bananalotto game (see provisions below), to five (5) of the numbers drawn for the relevant Bananalotto game, they may claim £10 Amazon voucher from Bananalotto. Details of how it is to be provided to confirm winners are set out in the Schedule.
Below 5 winning numbers: If a Player validly matches less than five (5) numbers correctly from any entry of theirs to Bananalotto to corresponding numbers drawn for the relevant Bananalotto game, they may claim a certain number of points which are redeemable for prizes as set out on the Site (called “Points”) as set out in the Schedule under “Other prizes” which will, if verified by Mediastay, be added to the relevant Player's Bananalotto account.
11. Claims, Verification and Awarding of Prizes
Winners must contact Mediastay and claim their prize within four (4) weeks of the announcement of the winners on the Site and via e-mail, after which time the prize will be withdrawn and the relevant winner will no longer be entitled to the prize in question.
Prizes will be awarded to winning players strictly subject to verification by Mediastay of the relevant winning numbers and satisfactory compliance of the relevant winner with these terms, conditions and rules as set out below.
Players will be required to prove, to the reasonable satisfaction of Mediastay or its partners, their compliance with the entry requirements set out in clause 6 above, including providing proof of age and identity and that the personal information entered when the Player registered is correct and up to date before Mediastay will verify and confirm that they are a winner entitled to the relevant prize in question.
Within 90 days of successful verification by Mediastay or its partners of compliance by the Player with these terms, conditions and rules, Mediastay will award the relevant prize to the relevant winner. Upon awarding of the prize, in the case of the First Prize or the Second Prize, the relevant winner must present their travel agent's booking to Mediastay for payment by Mediastay in accordance with the Schedule within 90 days of award of the prize.
Mediastay reserves the right to refuse to award any Player any prize only in the event that the Player in question's winning numbers cannot be reasonably verified by Mediastay or its partners or the Player in question is in breach of any of these terms, conditions and rules.
The process of drawing winning numbers, verifying winners and awarding prizes under these terms, conditions and rules will at all times be carried out under the supervision of an observer independent from Mediastay.
12. Points and Related Prizes
In the event that you win Points on Bananalotto in accordance with the above provisions, the Points will be added to your Bananalotto account in accordance with the above terms, and they may be directly redeemed for certain prizes as set out in the “Prizes” section of the Site, strictly subject to availability and while stocks last.
There are limited stocks of such prizes, Mediastay does not guarantee any such availability of stocks of such prizes, and in the event that stocks are not available, you agree to accept a reasonable equivalent. Such prizes represented on the Site may not precisely represent the actual item provided to you and there may be some variance in colours and materials.
Each Player may redeem (exchange) Points for up to a maximum of three (3) such prizes per month. Players will receive a confirmation e-mail each time Points are redeemed (exchanged) for such prizes.
The Player can redeem (exchange) the points to participate in "Tombolas". The Player can buy as many tombola tickets as points won at the lottery. The date of the draw is set at the time of the publication on the website.
The quota of points to exchange to participate in a Tombola and the closing dates for buying the tickets are decided by Mediastay. The opening and the closing dates for buying tickets for each Tombola are available on this address: www.bananalotto.co.uk
You acknowledge and accept that there will be no cash or other alternative to any prize awarded by Mediastay in connection with Bananalotto and the prizes, which are awarded, are strictly as stated in these terms, conditions and rules and on the Site. Prizes are non-transferable. If a prize or the award of a prize is invalid, illegal or unlawful Mediastay may cancel the award of the prize in question.
Players claiming the First Prize or Second Prize and any travelling companion(s), which they intend to include in their prize, must hold a valid passport and/or necessary travel documentation and visas details of which must be provided to Mediastay on request. If the passport or necessary identification and confirmation are not received within 10 working days of request, Mediastay may withhold the award of the relevant First Prize or Second prize the case may be.
Points collected over the time will be automatically lost if members don't play at least one game grid during the last 3 months of each year (October, November, December).
13. Single First Prize and Single Special Prize to be Shared
Only one First Prize and one Second Prize will be available in relation to each daily Draw for Bananalotto games.
The First Prize (5 valid numbers + 1 bonus number on 10th entry) and the Second Prize (six valid numbers on 10th entry) will be fully attributed in the case of a unique winner or shared pro rata the number of winners in the case of multiple winners.
In the case of several confirmed winners of a First Prize or Second Prize, the maximum value of the First Prize or Second Prize in question (as the case may be) as set out in the Schedule will be divided by the number of confirmed winners of that prize.
14. Data Protection
Mediastay Ltd is registered with The Information Commissioner's Office under the Data Protection Act 1998 (ICO Registration No. Z962923X). Mediastay will comply with the terms of the Data Protection Act 1998 (the “Act”), collecting, storing and processing any personal data (as defined in the Act) relating to Players. In this regard, all personal data relating to Players will be processed in accordance with Mediastay's Privacy Policy, which is available on the Site. Further details of your rights relating to your personal data under the Act can be found in this Privacy Policy.
15. Disclaimers and Limitation of Liability
Nothing in these terms, conditions and rules will disclaim or limit liability for any claim, demand and cause of action for death or personal injury caused by Mediastay's negligence.
Mediastay will not in any circumstances be liable or responsible for damage, theft, or loss (including consequential or economic loss including but not limited to loss of profits, loss of business, loss of or damage to data and loss of or damage to property) suffered in connection with any Bananalotto game or prize or travelling associated therewith, and all such .
Mediastay will not be liable or responsible in any way from any misuse of the Site, any Bananalotto game or any prize.
Mediastay is free to modify, suspend or cancel Bananalotto and to amend these terms, conditions and rules at any time in writing which amendments will be deemed to be agreed by you upon posting on the Site. Subject to the first provision of this clause 16 above, Mediastay will not be liable for any damage or expenses incurred by you or any other person as a result of such modification, suspension or cancellation of any Bananalotto game or amendment to these terms, conditions and rules.
You acknowledge that information, software and other material accessible over the Internet via the Site may contain viruses, worms, Trojan horses, cancel bots, or other harmful and destructive components. Mediastay will not be liable for any direct, indirect, incidental or other loss or damages, which result or may result from your access to or use of the Internet.
Mediastay will not be liable for entries which are made via the Site but are not received by Mediastay for any reason, including but not limited to errors, disruption or downtime of Site as referred to in clause 3 above which may, owing to corruption of data, lead to entries being lost or which may lead to entries to Bananalotto games being submitted incomplete or in multiples in which case such entries will be disregarded by Mediastay.
16. Players Invitation: "Tell-a-Friend"
Mediastay reserves the right to provide Players with a "Tell-a-Friend" referral system on the Site. If such a system becomes available, the Terms and Conditions of Participation in such referral system will be set out in the "Tell-a-Friend" section of the Site and will be binding on all Players using such referral system.
17. General
Mediastay will not be liable for any delay or failure to perform any duty or obligation under this Agreement due to any circumstances beyond Mediastay's reasonable control, including but without limitation any act of terrorism, war, civil unrest, strike, industrial action, failure of electronic or other systems and machinery and any other Act of God.
This Agreement constitutes the whole and only agreement Mediastay and the Player in relation to the subject matter hereof and supersedes and extinguishes any other agreement whether written or oral between them. If at any time any provision of these terms, conditions or rules is or becomes illegal, invalid or unenforceable in any respect such provision will be deemed to be removed from these terms, conditions and rules without affecting the legality or validity or enforceability of any other provision.
No delay by Mediastay in enforcing the provisions of this Agreement will prejudice or restrict the rights of Mediastay nor will any waiver of rights by Mediastay operate as a waiver of any subsequent breach by the Player of these terms, conditions and rules.
18. Governing Law
This competition and promotion is subject to English Law and is void where prohibited by local law
